Terms and Conditions

BOOKING/REGISTRATION:

The signing of the booking form confirms the acceptance of the Terms and Conditions below and shall be binding on all the persons intending to occupy the property. Once the booking is confirmed, the signatory is responsible for the total rental costs as agreed. Receipt of this agreement via fax shall also be binding.

The remaining balance must be paid 30 days before the arrival date.

DEPOSIT:

A deposit of $250 or 25% of the total booking, whichever is the higher, per reservation. This deposit is non refundable (see cancellation policy below) and immediately subtracted from the total booking amount leaving the balance to be paid on its due date which is 30 days prior to arrival.

PAYMENT:

Payment is accepted by credit card (Visa MasterCard, Discover and American Express) only.

SECURITY BOND/DAMAGE

A valid credit card must be given to act as a security deposit. Your credit card will not be charged unless there is any loss or damage to the property, which you will be notified of within 14 days of your departure.

DAMAGE/LOSSES ETC

In addition to damages and losses, deductions from the security deposit will be made if the home is left abnormally or exceptionally dirty, beyond a normal cleaning, or where carpet or furniture spillages require professional treatment. Late guest checkout with prior arrangement.

BALANCE

The outstanding balance is to be paid 30 days prior to arrival.

CHANGES TO BOOKINGS

Wherever possible, changes to the booking may be accommodated, although there will be a charge of US$35 per change. Amendments must be made in writing.

CANCELLATION/REFUND POLICY

In the event of a cancellation, the following conditions apply:

  • If a guest wishes to cancel their reservation 30 days or more prior to arrival then only the non refundable deposit will be retained.
  • No refunds are given on reservations cancelled less than 30 days prior to arrival.
  • All cancellations must be notified in writing and the day of receipt of the cancellation will apply as the effective date regarding the cancellation date and charges.

ACCOMMODATION/OCCUPANCY

Only the numbers of persons named on the booking form are allowed to stay at the property. Occupancy is set by the State of Florida as 2 guests per bedroom plus 2 more guests. The signatory must be a member of the party occupying the property and must be 21 years of age or older. The accommodation must not be shared, sub-let or assigned to any persons. We reserve the right to refuse admittance if this condition is not observed.

WHAT DO I NEED TO BRING?

Please understand that our vacation home is a self catering accommodation. Our home is supplied with one roll of toilet paper in each bathroom and one small hand soap per bathroom, 2 kitchen garbage bags ,one dishwasher tab,a small liquid soap, sponge, and a roll of paper towels. Any additional items not stated above will have to be purchased as well as any personal items (laundry detergent, shampoo / conditioner, bath soaps, fabric softener etc.)

SMOKING AND PETS POLICY

For the safety and comfort of all our guests, we do NOT allow smoking inside the property. We do NOT allow pets inside the property. Pets are not allowed inside the communal areas of the Encantada Resort.

NON-AVAILABILITY OF ENCANTADA RESORT AMENITIES

The swimming pool, club house and associated amenities are a free facility for which you are not charged. Occasionally, the facilities may not be available for maintenance purposes and the temperature of the pool is to some degree dependent on the local weather.

In this respect, please understand that the management of these facilities is undertaken by a management company appointed by the community and is not under our control. Where we are advised of scheduled maintenance work in advance of your booking, we undertake to pass this information to you prior to your booking. However, where we are advised of maintenance work after you have booked, we will of course pass this information on to you. We will not refund any portion of the rental fee for the accommodation and this will not be an acceptable reason for cancelling the booking without incurring the associated cancellation fee.

INSURANCE

We strongly advise that you take out appropriate travel/holiday and medical insurance for the duration of your vacation.

LIABILITY

During your stay, the owners, its representatives, management agents or owner agents do not accept any liability whatsoever for any personal injury, accidents, loss or damage to persons or personal effects however caused. The resort has a swimming pool, and the owners or management do not accept responsibility in the event of injury or death caused as a result of the use of pool. All children must be supervised at all times. All guests must follow the Encantada Resort rules and regulations.

CODE OF CONDUCT

The rental accommodation is situated on a resort development, which consists of both residential and vacation homes, therefore the owners, or owners agents or its representatives cannot be responsible for any on going construction, alterations to existing houses or any other nuisance as a result thereof on or around the housing development.

During their stay, the guests are responsible for the property and are expected to treat the home with care and respect as they would their own home. This includes the locking of the doors and windows each time they leave the home.

Encantada Resort is a family resort so please do not play loud music or do anything likely to inconvenience or annoy the neighbors after 2300 hours and before 0700 hours. In the event that anyone in your party behaves in such a way our management believes is likely to cause danger or distress or annoyance to anyone else on the property, the owners or their management reserve the right to terminate your stay immediately. The owners, their management or agents shall not be responsible for any costs you incur, provide any compensation nor make any refunds for this action.

ARRIVAL / DEPARTURE

The property is available at 4pm on the day of arrival and must be vacated by 10am on the day of departure. It may be possible to extend these times with prior arrangement with the agreement of the management company who need to access the property to make ready for the next guest at an additional fee. If you wish to extend your stay please contact the management company to avoid over booking.

COMPLAINTS

In the unlikely event of a problem arising, it should be discussed with the local property manager first. We will attempt to resolve any dispute immediately. We will not be held liable for the actions of any third party or public utility, or their inability to provide services, or any other service provider, over whom we do not exercise direct control. We will also not be held liable for any problems arising from or brought about, or become necessary, due to war, or threat of war, riot, civil commotion, terrorist act, industrial dispute, natural disaster, fire, flood, or adverse weather conditions or nuclear incident.

Any complaint regarding the property, services, damages or missing items etc. must be reported IMMEDIATELY to the property management company in writing. The property management company can only endeavor to find an appropriate solution to such issues if the complaint is registered. All complaints made after the departure date cannot be considered.

ALL HOLIDAY GUESTS

Every effort will be made by our management company to assist you with any queries you may have concerning your stay in our home. The management company or owner may contact you during your stay to check that everything is okay.

The owner/management company does reserve the right to enter the property in an emergency situation or for maintenance issues without notice. When possible, notice will be given. Access will be allowed.
